These Terms of Service ("Terms") are a legal agreement between you and Skootlink (Pty) Ltd (registration number 2026/386113/07) ("Deeply," "we," "us," or "our"), governing your access to and use of the Deeply app and website (together, the "Service").
By creating an account, you agree to these Terms and our Privacy Policy. If you don't agree, don't use Deeply.
1. Eligibility
You must be at least 18 years old to use Deeply. By creating an account, you confirm that:
- You are at least 18 years old.
- You have the legal capacity to enter into these Terms.
- You are not barred from using dating services under the laws of your jurisdiction.
- You have not been convicted of, or required to register as, a sexual offender.
- You will only maintain one active account.
- All information you provide is accurate and truthful, and you'll keep it up to date.
We may ask you to verify your identity or age at any time, and may suspend or terminate your account if we're unable to confirm you meet these requirements.
2. Your Account
You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us immediately at privacy@deeplydating.co.za if you suspect unauthorized access to your account.
You may delete your account at any time from Settings. See our Privacy Policy for what happens to your data when you do.
3. Acceptable Use
You agree not to, and not to attempt to:
- Misrepresent your identity, age, or any information on your profile.
- Impersonate another person, or create an account on behalf of someone else without their permission.
- Use Deeply for any commercial purpose, including advertising, soliciting, or promoting goods or services, without our written consent.
- Harass, threaten, stalk, or abuse another user.
- Post or send content that is unlawful, obscene, defamatory, hateful, or that promotes violence or discrimination.
- Post or send sexually explicit content, or solicit sexual content from another user without their consent.
- Send unsolicited commercial messages, chain letters, or spam.
- Scrape, harvest, or otherwise collect information about other users, including through automated means.
- Upload viruses, malware, or attempt to interfere with or disrupt the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly permits it.
- Use Deeply if you've previously been banned, or to circumvent a ban on another account.
- Solicit money, gifts, or financial information from other users, including through romance scams.
- Use bots, scripts, or other automated means to interact with the Service.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section — including removing content, issuing warnings, suspending, or permanently terminating accounts, with or without notice.
Deeply has zero tolerance for child sexual abuse and exploitation (CSAE). You may never use Deeply to create, upload, share, solicit, or link to content that sexually exploits, abuses, or endangers a child, including child sexual abuse material (CSAM), grooming, sextortion of a minor, or trafficking of a minor for a sexual purpose. Any account involved in this activity will be permanently banned immediately and reported to the National Center for Missing & Exploited Children (NCMEC), the South African Police Service, and/or other relevant authorities, without prior notice.
4. Reporting and Moderation
If you encounter behavior that violates these Terms, please report it using the in-app reporting tools or by contacting us. We review reports and take action we consider appropriate, which may include content removal, warnings, suspension, or a permanent ban. We use a combination of automated tools and human review to moderate content, but we cannot guarantee we'll catch every violation before you see it.
Reports involving suspected child sexual abuse material (CSAM) or child sexual abuse and exploitation (CSAE) are treated as an immediate priority. Where we obtain actual knowledge of CSAM on the Service, we remove it and report it to the National Center for Missing & Exploited Children (NCMEC), the South African Police Service, and/or the relevant authorities in the applicable jurisdiction, in accordance with applicable law. 5. Content You Share
You retain ownership of the photos, audio, bio, and other content you upload to Deeply ("Your Content"). By posting Your Content, you grant Deeply a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating and promoting the Service (for example, showing your profile to other users, or featuring anonymized examples in marketing with your separate consent).
You're solely responsible for Your Content. You confirm that you own or have the necessary rights to share it, and that it doesn't violate these Terms, infringe anyone else's rights, or break the law.
We may remove any content that violates these Terms or that we otherwise consider inappropriate, at our discretion and without prior notice.
6. Your Safety
Deeply provides a platform to meet people — we do not conduct comprehensive background checks on our users, and we cannot guarantee the identity, intentions, or safety of anyone you interact with.
Photo and ID verification, where completed, confirm that a user's photos match a live selfie and that basic age requirements appear to be met at the time of verification — they are not a background check and do not guarantee a person's identity, criminal history, or intentions.
You are solely responsible for your own safety when using Deeply and when meeting anyone in person. We strongly recommend that you:
- Never send money, gift cards, or financial information to anyone you meet on Deeply, no matter the reason given.
- Get to know someone through the app before meeting in person, and stay alert to inconsistencies in what they tell you.
- Tell a friend or family member where you're going and who you're meeting, before you meet.
- Meet in a public place for the first time, and arrange your own transportation.
- Trust your instincts — if something feels wrong, leave.
If you believe you or someone else is in immediate danger, contact local emergency services first, then report the user to us.
To the fullest extent permitted by law, Skootlink (Pty) Ltd is not responsible or liable for the conduct of any user, on or off the Service, including in-person interactions arranged through Deeply.
7. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKOOTLINK (PTY) LTD, ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY INTERACTIONS WITH OTHER USERS, WHETHER ONLINE OR IN PERSON.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ZAR 500.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under South African law, including the Consumer Protection Act, 2008, where it applies to your use of the Service.
8. Indemnification
You agree to indemnify and hold harmless Skootlink (Pty) Ltd, its directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: your use of the Service; Your Content; your violation of these Terms; or your interactions with other users, on or off the Service.
9. Sparks (Virtual Currency)
Deeply uses "Sparks," a virtual, in-app currency, to unlock certain features (such as Super Likes, message requests before matching, profile boosts, and other paid actions described in the app).
- Sparks have no monetary value, cannot be exchanged for cash, and cannot be transferred between accounts.
- Sparks can be earned through your monthly free grant, or purchased through Google Play Billing (on Android) or PayFast (on the web), depending on platform.
- The cost of each Sparks-based action is set by us and may change at any time; the current cost is always shown in the app before you confirm an action.
- Purchases of Sparks are generally final and non-refundable, except where required by law, or as provided by Google Play's own refund policies for in-app purchases made through the Play Store.
- We may adjust, discontinue, or expire unused Sparks if your account is terminated for violating these Terms.
10. Verification Fees
Optional identity verification may require payment of a fee, as shown in the app before you proceed. This fee covers the cost of processing your verification and is non-refundable once verification has been attempted, whether or not verification succeeds, except where required by law.
11. Subscriptions and Purchases
Where Deeply offers subscriptions or other purchases through the Apple App Store or Google Play Store, those purchases are also subject to the respective store's terms and billing policies, including automatic renewal terms disclosed at the time of purchase. You can manage or cancel subscriptions through your app store account settings.
12. Termination
You may stop using Deeply and delete your account at any time.
We may suspend or terminate your account, with or without notice, if we believe you've violated these Terms, engaged in fraudulent or illegal activity, or created risk or possible legal exposure for us or other users. Where we terminate your account for a violation, any unused Sparks are forfeited, and you may be barred from creating a new account.
Sections of these Terms that by their nature should survive termination (including Sections 5, 6, 7, 8, and 14) will continue to apply after your account is terminated or deleted.
13. Intellectual Property
The Deeply name, logo, app, and all associated content (excluding Your Content) are owned by Skootlink (Pty) Ltd or our licensors, and are protected by copyright, trademark, and other laws. You may not use our trademarks, branding, or app design without our prior written permission.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles. You agree that any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of South Africa.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll notify you through the app, by email, or by posting a notice before the changes take effect. Your continued use of Deeply after a change takes effect means you accept the updated Terms.
16. General
Severability: if any part of these Terms is found unenforceable, the rest will remain in full effect.
No waiver: our failure to enforce any part of these Terms is not a waiver of our right to do so later.
Assignment: you may not transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service, and supersede any prior agreements.
